Terms of Service • Effective Date: September 15, 2026
Section 1: Acceptance, Account Registration, and Security
1. Binding Agreement: These Terms constitute a legally binding contract between you and Theory Seven.
2. Age Requirement: You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use the Service. If you are between 13 and 17 years old, you may only use the Service under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms.
3. Account Confidentiality: You are responsible for maintaining the confidentiality of your account login credentials and for all activities conducted under your account. You agree to notify us immediately at info@theorysevenbrand.com if you suspect any unauthorized access.
Section 2: Health and Medical Disclaimer (Important Safety Notice)
Informational Purposes Only: Theory Seven provides fitness plans, AI-generated workout recommendations, exercise demonstrations, telemetry tracking, and community features for general informational, educational, and entertainment purposes only.
Not Medical Advice: Theory Seven is NOT a medical provider or healthcare organization. The Service does not provide medical advice, diagnosis, or treatment. Consult your physician before beginning any workout program. Discontinue exercise immediately if you experience faintness, dizziness, shortness of breath, chest pain, or severe pain, and seek emergency medical attention.
Section 3: AI Workout Generation and Telemetry Limitations
1. Algorithmic Personalization: Theory Seven uses artificial intelligence and telemetry to suggest workout structures, target reps, sets, and recovery recommendations algorithmically based on user-entered data and synced biometric telemetry.
2. No Guarantee of Results: We do not guarantee specific fitness outcomes, weight loss, muscle gain, or performance benchmarks.
Section 4: Community Guidelines, Circles, and User Content
1. User Generated Content: You retain ownership of content you post within Theory Seven Public Feed, Groups, or Circles. By posting, you grant Theory Seven a worldwide, royalty-free license to host and display your content.
2. Prohibited Conduct: You agree NOT to post content that is illegal, defamatory, threatening, sexually explicit, hate speech, harassment, spam, or infringing third-party rights.
Section 5: App Store and Google Play EULA Acknowledgment
1. Apple and Google Disclaimer: You acknowledge that these Terms are entered into between you and Theory Seven only, and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Service.
2. Third-Party Beneficiaries: Apple and Google have the right to enforce these Terms against you as third-party beneficiaries.
Section 6: In-App Purchases, Shopify Store, and Subscriptions
1. Store Purchases: Purchases made through the Theory Seven Store are processed securely via Shopify integration.
2. Auto-Renewal: Recurring subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period in your Apple ID or Google Play settings.
Section 7: Limitation of Liability and Binding Arbitration
1. Limitation of Liability: To the maximum extent permitted by law, Theory Seven shall not be liable for any indirect, incidental, or consequential damages.
2. Binding Individual Arbitration: Any dispute or claim arising out of these Terms shall be settled by binding individual arbitration. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS.
